The legal maximum commission

Estate agency fees are capped by the scale of fees in the Seventh Schedule to the Valuers, Appraisers, Estate Agents and Property Managers Rules 1986, made under Act 242. The scale is a ceiling, not a price list. Below it, the fee is whatever you and your client agree in writing.

Tenancies over five years with an option to renew may carry an extra 0.25 month per additional year, and tenancies under a year may be charged pro rata. The lettings scale does not apply to serviced offices or serviced apartments, and sales and marketing of new projects is priced by agreement with the developer.

Worked example

A RM650,000 subsale at 2% is a RM13,000 fee. With SST the client pays RM14,040, and RM1,040 of that goes to Customs. If it was a 50/50 co-broke, RM6,500 goes to the other agency. On a 70% split you take home RM4,550 and your agency keeps RM1,950.

Frequently asked questions

What is the maximum property agent commission in Malaysia?+

For a sale or purchase, 3% of the price, with a minimum fee of RM1,000 per property. For a rental, 1.25 months of rent for a tenancy of up to three years, 1.5 months for over three to four years, and 1.75 months beyond four years. These come from the scale of fees the Board of Valuers, Appraisers, Estate Agents and Property Managers publishes under the Valuers, Appraisers, Estate Agents and Property Managers Rules 1986.

Is 3% the standard commission?+

No, 3% is the ceiling. Anything at or below it is whatever the owner and the agency agree in writing. Subsale fees are often agreed below the ceiling, and developers set their own rates for new projects, which fall outside the sale scale.

Is there SST on agent commission?+

Yes, if the agency is registered for service tax. Estate agency is a taxable professional service, charged at 8% since 1 March 2024. Registration is compulsory once a firm's taxable turnover passes RM500,000 in 12 months, so smaller agencies may not charge it. The tax is on top of the fee and goes to the Royal Malaysian Customs Department.

Who pays the agent in a rental, the landlord or the tenant?+

Whoever appointed the agent. In most Malaysian rentals that is the landlord. If a tenant appoints their own agent, the tenant pays that agent. Put it in the appointment letter before you start marketing.

How is commission split in a co-broke?+

The two agencies agree it between themselves, most often 50/50. The fee is invoiced by the listing agency and the co-broke share is paid agency to agency, never to the negotiator personally. Each agency then pays its own REN under its own split.

Can a REN collect commission directly from the client?+

No. A REN works under a registered estate agency, and fees are invoiced and received by that agency. Your share reaches you from the agency, under your agency's commission policy.

What split does a REN usually get?+

It depends entirely on the agency and your volume, and it varies widely. Many agencies use a ladder that rises with your yearly sales, and some pay a higher split in exchange for a desk or marketing fee. The calculator lets you enter your own.
